Agreement to Terms

These Terms of Use constitute a legally binding agreement between you and The Fresh House LLC doing business as Amplify Systems (“Amplify Systems”, “we”, “us”, or “our”), concerning your access to and use of https://amplifysystems.io and any related media, channels, or mobile applications (collectively, the “Site”).

By accessing the Site, you confirm that you have read, understood, and agreed to be bound by all of these Terms. The Site is intended for users who are at least 18 years old.

We reserve the right to make changes or modifications to these Terms at any time. We will alert you by updating the “Last Updated” date above. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, text, photographs, and graphics (collectively, the “Content”) and all trademarks, service marks, and logos (the “Marks”) are owned or controlled by us and are protected by copyright, trademark, and other applicable laws.

You are granted a limited license to access and use the Site and to download or print Content solely for your personal, non-commercial use. We reserve all rights not expressly granted.

User Representations

By using the Site, you represent and warrant that:

  1. You have the legal capacity to agree to these Terms.
  2. You are not a minor in your jurisdiction of residence.
  3. You will not access the Site through automated or non-human means.
  4. You will not use the Site for any illegal or unauthorized purpose.
  5. Your use of the Site will not violate any applicable law or regulation.

Prohibited Activities

You agree not to:

  1. Systematically retrieve data to create a database or directory without written permission.
  2. Make any unauthorized use of the Site, including harvesting email addresses for unsolicited messages.
  3. Use the Site to advertise or offer goods and services without approval.
  4. Circumvent, disable, or interfere with security-related features of the Site.
  5. Engage in unauthorized framing of or linking to the Site.
  6. Use any automated system — spider, robot, scraper — to access the Site.
  7. Attempt to impersonate another user or person.
  8. Sell or transfer your profile.
  9. Use the Site in connection with any effort to compete with us.
  10. Decipher, decompile, disassemble, or reverse engineer any part of the Site.
  11. Harass, annoy, intimidate, or threaten our employees or agents.
  12. Upload viruses, Trojan horses, or other harmful material.
  13. Use the Site in any way inconsistent with applicable laws or regulations.

HighLevel Sub-Account Non-Transfer Policy

When you enroll in any Amplify Systems service that includes a HighLevel sub-account (including Amplify OS, partner programs, or managed automation services), that sub-account is provisioned within the Amplify Systems agency and contains proprietary intellectual property — including automation workflows, AI conversation sequences, campaign snapshots, custom values, pipeline configurations, and content assets — owned exclusively by Amplify Systems / The Fresh House LLC.

By enrolling, you agree that:

  1. The sub-account and all proprietary automation content within it will remain hosted under the Amplify Systems HighLevel agency at all times.
  2. The sub-account may not be transferred, migrated, cloned, or ported to any other HighLevel agency, reseller, or platform for any reason.
  3. You may export your contact data (name, email, phone, and standard CRM contact fields) at any time from within your HighLevel account.
  4. Upon cancellation or termination of your subscription, you are responsible for exporting any contact data you wish to retain prior to deprovisioning. Amplify Systems is not responsible for contact data not exported before account closure.
  5. Attempting to transfer, copy, reverse-engineer, or replicate proprietary automations, workflows, or snapshot content constitutes a violation of our Intellectual Property Rights and these Terms, and may result in immediate termination and legal action.

Submissions

Any questions, comments, suggestions, ideas, or feedback you provide become our sole property. We own exclusive rights, including all intellectual property rights, and may use them for any lawful purpose without acknowledgment or compensation to you.

Site Management

We reserve the right to monitor the Site for violations; take appropriate legal action against anyone who violates these Terms; refuse, restrict, or disable any contributions; and otherwise manage the Site to protect our rights and property.

Privacy Policy

We care about data privacy and security. Please review our Privacy Policy. By using the Site, you agree to be bound by it, which is incorporated into these Terms.

Term and Termination

These Terms remain in full force while you use the Site. We reserve the right to deny access to any person for any reason, including breach of these Terms. If we terminate your account, you are prohibited from creating a new account.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time without notice. We cannot guarantee the Site will be available at all times and will not be liable for any loss or inconvenience caused by downtime.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.

Dispute Resolution

Any legal action shall be commenced or prosecuted in the state and federal courts located in Wyoming, United States. No claim may be brought more than one (1) year after the cause of action arose.

Disclaimer

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT.

Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR LOST REVENUE, ARISING FROM YOUR USE OF THE SITE. OUR LIABILITY TO YOU FOR ANY CAUSE WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION.

Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim arising from your use of the Site, breach of these Terms, or violation of the rights of any third party.

Electronic Communications

Visiting the Site, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree they satisfy any legal writing requirement.

Miscellaneous

These Terms and any policies posted by us constitute the entire agreement between you and us. Our failure to enforce any right or provision does not waive that right or provision. If any provision is determined unlawful or unenforceable, the remaining provisions remain in full effect.
